Welcome to the software products and services provided by FikaYard (hereinafter the "Service" or "we"). These Terms of Service (hereinafter the "Terms") constitute an agreement between 菲卡雅德股份有限公司（Fikayard） (Tax ID: 90676855, hereinafter the "Company") and you (hereinafter the "User" or "you") regarding your use of the Service. When you register for, access, or use any product of the Service, you are deemed to have read, understood, and agreed to be bound by the entirety of these Terms.

1. Scope of Service

Through ai.fikayard.com and the websites of its various products, the Company provides online digital software services including but not limited to real-time translation (FikaMeet), AI voice agents (FikaCall), smart investing (WealthPulse), and short-video creation (inShow), delivered on a monthly / annual subscription basis. The features, specifications, and pricing plans of each product are as set out on the relevant product page and at checkout.

2. Account Registration and Security

• You shall provide accurate, current, and complete registration information, and update it promptly whenever it changes.
• You must keep your account and password secure, and you are fully responsible for all activities carried out under your account.
• If you discover any unauthorized use of your account or other security concerns, you should notify the Company immediately.
• Some products of the Service are offered on an invite-only basis or as free trials during the beta phase; the relevant rights and limitations are governed by the announcements for that product.

3. Rules of Use

In using the Service, you agree not to engage in any of the following:

• Any act that violates the laws of the Republic of China (Taiwan) or infringes the rights of others.
• Uploading, transmitting, or generating any content that is illegal, defamatory, infringes intellectual property rights, or offends public order and good morals.
• Using automated programs, reverse engineering, or other improper means to interfere with, damage, or circumvent the normal operation and billing mechanisms of the Service.
• Reselling, leasing, or otherwise making the Service available to unauthorized third parties.

4. Payment and Billing

• The fees for paid products and the billing method (monthly / annual subscription cycle) are as shown on the checkout page.
• Online credit-card payments are provided by "a third-party secure payment provider", and the transaction currency is TWD (New Taiwan Dollar).
• Subscription services automatically renew and are charged at the end of each cycle; you may cancel before the agreed deadline to avoid the next charge.
• Refund-related matters are handled in accordance with this site's Refund Policy.

5. Intellectual Property

The intellectual property rights in the software, interface, trademarks, text, images, and other content of the Service — except for content uploaded or generated by users themselves — belong to the Company or the rightful owners. Without prior written consent, you may not reproduce, distribute, adapt, or otherwise commercially exploit them.

6. Third-Party Services

The operation of the Service may integrate third-party technologies and services (such as AI model providers, cloud, and payment service providers). The use of such third-party services is additionally governed by their respective terms of service and privacy policies.

7. Changes and Interruptions to Service

The Company may, at any time, add to, modify, suspend, or terminate all or part of the Service due to factors such as product upgrades, maintenance, legal requirements, or force majeure, and will announce such changes a reasonable period in advance where possible. The Company shall not be liable for damages arising from service interruptions not attributable to the Company.

8. Disclaimer and Limitation of Liability

The outputs of the Service (including AI translation, voice, generation, and other features) are for reference only, and the Company does not warrant that they are entirely accurate, timely, or suitable for any particular purpose. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, the Service.

9. Amendments to the Terms

The Company may amend these Terms at any time and announce the changes on this site. If you continue to use the Service after the amendment, you are deemed to have agreed to the amended content.

10. Governing Law and Jurisdiction

The interpretation and application of these Terms shall be governed by the laws of the Republic of China (Taiwan). For any dispute arising from these Terms, the parties agree that the Taiwan Yunlin District Court shall be the court of first instance.
